The High Court of Madhya Pradesh has rejected a woman’s appeal against the annulment of her marriage, asserting that her inappropriate discussions with other men amounted to mental cruelty to her husband, thereby legitimizing the divorce on the basis of cruelty.
The family court had issued the divorce due to cruelty against the man, and the High Court panel consisting of Justice Vivek Rusia and Justice Gajendra Singh recently confirmed the ruling.
The court observed that the woman was discussing her sex life with male acquaintances and mentioned that no husband would accept such conduct.
“No husband would tolerate that his wife is in conversation through a mobile by way of these type of vulgar chat,” legal news portal Bar and Bench quoted the bench as saying.
“Following marriage, both partners have the liberty to communicate via mobile, chat, and other methods with friends, but the nature of the conversation must remain respectful and dignified, particularly when engaging with the opposite gender, so as not to offend the spouse,” it stated.
The court additionally emphasized that if one partner persists in these actions despite the other’s objections, it would certainly be considered mental cruelty.

The couple wed in 2018. As per the husband’s grievance, the woman would chat with “her former partners on her phone” post-marriage. He also claimed that the WhatsApp chats were vulgar in nature.
Nonetheless, the woman rejected the allegations, stating that she did not have any such relationship. She further alleged that her spouse had breached her mobile phone and transmitted those messages to the two men to fabricate evidence against her.
The woman also claimed that her husband’s behavior infringed upon her right to privacy. She additionally made an allegation of a Rs 25 lakh dowry demand against him.
Nonetheless, the court deemed the man’s claims valid, and the woman’s father also stated that his daughter often conversed with her male friends. As a result, it affirmed the divorce awarded by the lower court.
