The Supreme Court granted bail to Bibhav Kumar, an aide of Delhi CM Kejriwal, who was arrested for allegedly assaulting AAP Rajya Sabha MP Swati Maliwal.

Supreme Court grants bail to Bibhav Kumar

The Supreme Court granted bail to Bibhav Kumar, an aide of Delhi Chief Minister Arvind Kejriwal, who was arrested for allegedly attacking Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal.

Justices Surya Kant and Ujjal Bhuyan were presiding over Kumar’s bail plea and challenge to his arrest in the case.

Justice Bhuyan observed Kumar had been detained for 100 days

Justice Bhuyan pointed out during the hearing that Bibhav Kumar had spent 100 days in judicial custody and a chargesheet had been submitted.

“Injuries (to Maliwal) are simple. It’s a case for bail. You should not oppose. You can’t keep a person in jail in such a case,” Justice Bhuyan said.

Additional Solicitor General SV Raju, appearing for the Delhi Police, said, “There are certain important witnesses, who are under his (Bibhav) influence. Let them be examined. I won’t oppose then.”

Swati Maliwal had accused Bibhav of assaulting her at CM’s residence

On May 13, Swati Maliwal accused Bibhav Kumar of assaulting her at the Chief Minister’s residence. The medical examination conducted by AIIMS showed bruises on her face and leg.

The Delhi Police arrested Bibhav Kumar on May 18 following the registration of a case against him under Sections 308, 341, 354B, 506 of the Indian Penal Code (IPC).

Delhi court prolonged Kumar’s judicial custody, which started last month till September 13 .
