A Delhi court was left stunned when a convict and his lawyer threatened and hurled abuses at the woman judge in open court following conviction in a cheque bounce case.
The accused even attempted to hurl an object at the judge for not delivering an order in his favor. He then instructed his lawyer to do whatever it took to secure a favorable judgment.
“Tu hai kya cheez ………….ki tu bahar mil dekhte hai kaise zinda ghar jaati hai……..(Who even are you… just meet me outside and let’s see how you make it back home alive),” the accused told the judge as noted in the Court’s order dated April 2.
Judicial Magistrate (NI Act) Shivangi Mangla had convicted the accused for offence punishable under Section 138 (dishonor of cheque) of the Negotiable Instruments Act and was directed to furnish bail bonds under Section 437A CrPC on the next date of hearing.
However, following the conviction, the accused and his counsel allegedly harassed the lady judge both mentally and physically, pressuring her to resign from her post, Judge Mangla recorded in her order.
They again subjected her to harassment, demanding that she acquit the accused.
They also threatened to file a complaint against her and forcibly secure her resignation.
The judge said that appropriate action shall be initiated against the accused before the National Commission for Women for the threats and harassment.
“Still the undersigned stand against all the odds and always do needful in favor of justice. The undersigned shall be taking appropriate measures against the accused before National Commission Woman, Delhi for such threatening and harassment,” the Court directed.
The judge also issued a show cause notice to the convict’s lawyer, advocate Atul Kumar, seeking an explanation as to why criminal contempt proceedings should not be initiated against him for misbehaving with her.
