Legal Battle Over Government Cuts: Democratic state attorneys general are challenging Elon Musk’s Department of Government Efficiency, seeking to block the team from accessing sensitive government systems and making drastic cuts.

A legal battle is unfolding in Washington, D.C., where a federal judge has scheduled an unusual Presidents Day hearing to address a lawsuit challenging the authority of Elon Musk’s government cost-cutting initiative. The lawsuit, filed by a coalition of Democratic state attorneys general, seeks to limit the reach of Musk’s team, known as DOGE (Department of Government Efficiency), within federal agencies.
The states’ central argument rests on the Appointments Clause of the U.S. Constitution. They contend that Musk’s sweeping authority over federal agencies is akin to that of a government officer, a position that requires presidential nomination and Senate confirmation. “Although our constitutional system was designed to prevent the abuses of an 18th-century monarch, the instruments of unchecked power are no less dangerous in the hands of a 21st-century tech baron,”

stated New Mexico Attorney General Raul Torrez, one of the leading figures in the lawsuit. The lawsuit further alleges that DOGE lacks the necessary authorization from Congress to wield such influence over federal operations.
