Supreme Court takes note of Justice Yadav’s controversial remarks

The Supreme Court has acknowledged a contentious remark made by a judge of the Allahabad High Court during an event hosted by the Vishwa Hindu Parishad (VHP). The development followed after Chief Justice of India (CJI) Sanjiv Khanna got complaints requesting suitable measures against Justice Shekhar Kumar Yadav for his address aimed at a particular community.

The Supreme Court has acknowledged a contentious remark made by a judge of the Allahabad High Court during an event hosted by the Vishwa Hindu Parishad (VHP). The development followed after Chief Justice of India (CJI) Sanjiv Khanna got complaints requesting suitable measures against Justice Shekhar Kumar Yadav for his address aimed at a particular community.

“The details and particulars have been called from the High Court and the matter is under consideration,” the Supreme Court has said.

The matter was also raised in the Lok Sabha, as MP Asaduddin Owaisi submitted a notice requesting the dismissal of Justice Shekhar Kumar Yadav. In a post on X, Owaisi stated that the judge’s conduct breached constitutional standards.

“I have signed a notice seeking removal proceedings against Shekhar Yadav, judge of Allahabad High Court. The notice requires the signature of 100 Lok Sabha members to be considered by the Lok Sabha Speaker,” the AIMIM supremo said.

Last week, during an event hosted by the legal cell of Vishwa Hindu Parishad, Justice Yadav stated that India would operate according to the desires of the majority (i.e., the Hindus).

Justice Yadav questioned how the children could be kind and tolerant if they witnessed animals being slaughtered in front of them from a young age, without specifically naming the Muslim community. He also stated that although not everyone from the community is bad, “kathmullas are dangerous for the country.”

During an event held by the legal cell of Vishwa Hindu Parishad last week, Justice Yadav stated that India would operate according to the preferences of the majority (i.e., the Hindus).

Justice Yadav inquired about how children could develop kindness and tolerance when they witness animals being slaughtered in front of them from a young age, without mentioning the Muslim community by name. He also mentioned that although not everyone from the community is bad, “kathmullas are fatal for the nation.”

On Monday, CPI(M) figure Brinda Karat and the Campaign for Judicial Accountability and Reforms (CJAR) sent a letter to the Chief Justice voicing their worries about Justice Yadav’s remarks.

In its correspondence, the CJAR has requested an internal investigation into Justice Shekhar Yadav. It has asked the CJI to relieve the judge of all judicial responsibilities while the inquiry is ongoing. It also remarked that Justice Yadav’s remarks at the VHP event indicated a deficiency in impartiality, fairness, and neutrality in performing his judicial duties.

Former Rajya Sabha MP Brinda Karat stated in her letter that such actions tarnish the reputation of the judiciary and the whole judicial system. Karat underscored that the judiciary has no room for individuals who display such bias.
