The recent Chandigarh Mayor election took an unexpected turn on Tuesday, as the Supreme Court intervened, overturning the initial result and declaring the Aam Aadmi Party (AAP) candidate Kuldeep Kumar as the rightful winner. The controversy erupted after Returning Officer Anil Masih invalidated eight AAP votes, sparking allegations of tampering with the ballots.
The Supreme Court, led by Chief Justice DY Chandrachud, deemed severe faults in the conduct of the election and ordered prosecution against Anil Masih for “misdemeanour.”
“Setting aside the election process itself would not be proper since the issue is only when the presiding officer made the counting”, the bench observed. Additionally, a show cause notice was issued against Masih, highlighting the gravity of the irregularities.
What did the Supreme Court Rule?
In its ruling, the Supreme Court declared Kuldeep Kumar to be the validly elected mayor of Chandigarh Municipal Corporation, overturning the previous election result.
CJI Chandrachud emphasized the significance of rectifying the election process by counting the eight disputed votes for the AAP candidate, which brought his tally to 20 votes, ultimately leading to his victory.
“I would like to thank the Supreme Court. This is a win for the people of Chandigarh and the INDIA alliance. This shows that the BJP is not unbeatable and we can defeat them if we stay united,” said Kuldeep Kumar who has been declared the winner of Chandigarh Mayoral polls by the Supreme Court via PTI.
